3. Role of Fairway Finder

Fairway Finder acts as a booking agent on your behalf.

When you request a booking through Fairway Finder:

• You authorize us to act as your agent
• We attempt to complete the booking on your behalf through third-party systems
• The golf course remains the provider of the tee time and related services

Fairway Finder is not the seller of tee times and does not control course operations, pricing, or policies.

4. Booking Authorization (Critical Section)

By using the booking feature, you expressly authorize Fairway Finder to:

• Act as your agent to secure tee time reservations
• Input your personal information into third-party booking systems
• Use payment methods (including virtual payment instruments) to complete bookings on your behalf
• Agree to course-specific terms and conditions on your behalf where necessary

This authorization is granted each time you initiate a booking request through the Services.

5. Payments and Fees

5.1 Fairway Finder Fees

Fairway Finder may charge a convenience fee at the time of booking. This fee is non-refundable unless otherwise stated.

5.2 Golf Course Charges

Golf courses may require:

• Full payment
• Partial deposits
• Credit card holds for no-show or late cancellation fees

These charges are determined solely by the golf course.

5.3 Payment Facilitation

In some cases, Fairway Finder may:

• Facilitate payments using third-party payment providers
• Use virtual payment instruments to complete transactions on your behalf

You authorize Fairway Finder to charge your payment method for:

• Any deposits or fees required by the course
• Any no-show or late cancellation fees incurred
• Any amounts incurred in connection with your booking

6. Cancellations, Refunds, and No-Shows

6.1 Course Policies Apply

All cancellations are subject to the golf course's policies, which may vary.

6.2 Refunds

If a refund is issued by a golf course:

• Fairway Finder will pass that refund back to you where applicable
• Timing may vary depending on payment processing systems

6.3 No-Show / Late Cancellation Fees

You are responsible for any fees charged by the course due to:

• Failure to show up
• Late cancellation

Fairway Finder may charge your payment method to recover these costs.

7. Accuracy of Information

Fairway Finder aggregates tee time data from publicly available sources.

We do not guarantee:

• Accuracy of pricing
• Availability of tee times
• Completeness of course information

Tee times may change or become unavailable at any time.

8. Third-Party Services

Your booking ultimately occurs with a third-party golf course.

Fairway Finder is not responsible for:

• Course conditions
• Service quality
• Cancellations or overbookings
• Errors originating from third-party systems

9. Subscriptions (Alerts)

Fairway Finder offers subscription-based services for alerts.

• Subscriptions may be billed monthly or annually
• Subscriptions automatically renew unless canceled prior to renewal
• You may cancel at any time to prevent future billing

Except where required by law, subscription fees are non-refundable.

10. User Responsibilities

You agree to:

• Provide accurate and complete information
• Use the Services in good faith
• Comply with golf course policies
• Honor all bookings made on your behalf

You are responsible for all activity under your account.

11. No Affiliation with Golf Courses

Unless explicitly stated, Fairway Finder is not affiliated with, endorsed by, or partnered with any golf course.

12. Limitation of Liability

To the maximum extent permitted by law, Fairway Finder shall not be liable for:

• Booking failures
• Pricing discrepancies
• Tee time availability issues
• Course cancellations or overbookings
• Indirect, incidental, or consequential damages

Our total liability shall not exceed the amount paid by you to Fairway Finder in the preceding 12 months.

13. Dispute Resolution

13.1 Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration.

13.2 Class Action Waiver

You agree not to participate in any class action lawsuit against Fairway Finder.

14. Geographic Use

Fairway Finder is currently intended for users in the United States and Canada.

Fairway Finder may develop additional services, including analytics and data products. Use of such services may be governed by additional terms.
